AUDAX collects and processes personal information that may come from various sources. Generally, the personal data that AUDAX will process from Users through the Website will come from the following sources:

  • Data provided directly by the User (e.g. name and surname, NIF, telephone, e-mail, IBAN, etc.).
  • Data observed as a result of the development and processing of the contractual relationship (e.g. products contracted, consumption, etc.).
  • Data from third parties (e.g., credit reporting agencies, etc.)

AUDAX will process the following types of User data, although their extent and limitation will depend on the specific purposes for which they are intended:

3. FOR WHAT PURPOSE AND UNDER WHAT LEGAL BASIS WILL WE PROCESS YOUR PERSONAL DATA?

Maintain, develop and manage the contractual relationship.The execution of the contract entered into with the User.
When you requested it, we will manage your registration as a user of our Customer Area.The consent you give us when you request your registration as a User in the AUDAX Customer Area.
To send you informational communications related to the products and services contracted or linked to your contractual relationship with AUDAX.The execution of the contract entered into with the User.
To contact you through any means, including electronic means, to send commercial communications regarding products or services marketed by AUDAX, provided they are similar to those initially contracted by the User.AUDAX's legitimate interest, consisting of the User's reasonable expectation of receiving information about products and services similar to those contracted.
To resolve the requests, doubts and/or petitions that you make as a User of the Website, or in the course of your contractual relationship with AUDAX.The consent you give us when you submit your request through any of the forms that AUDAX has enabled for this purpose, or the execution of the contract entered into with the User.
Managing non-payments and debt collection.AUDAX's legitimate interest in collecting the amounts owed by its customers.
Conduct statistical studies for internal administrative purposes.AUDAX's legitimate interest, with respect to strategic decision-making and business management of the AUDAX Group in accordance with applicable regulations.
Evaluate the quality of service.AUDAX's legitimate interest in relation to the evaluation of the quality of service provided by our Customer Service team.
Compliance with legal obligations that AUDAX must face.Compliance with a legal obligation (the corresponding one, if applicable) to which AUDAX is subject.
Maintain a business relationship (as applicable):
a. With the legal entity in which you provide your services;
b. With you, in your capacity as a sole proprietor or self-employed professional.
AUDAX's legitimate interest, in accordance with the provisions of Article 19 of the LOPDGDD.
Manage your application as an AUDAX business partner.The application of pre-contractual measures at the User's request.
Manage your registration as a user of the AUDAX Commercial Area.The execution of the contract entered into with the User.
4. HOW LONG WILL WE PROCESS AND RETAIN YOUR PERSONAL DATA?

AUDAX will retain your personal data in accordance with legally established timeframes. If there is no legal retention period, we will not store your information for longer than necessary to fulfill the specific purpose indicated above.

In turn, the processing that was based on the consent or legitimate interest of AUDAX will be kept until the moment in which its revocation occurs, or until you exercise your right of deletion or objection to receiving commercial communications.

Should such circumstances arise, AUDAX will keep your data duly blocked for the time necessary to comply with our legal obligations according to the applicable statutes of limitations. Once these periods have elapsed, your data will be permanently destroyed and deleted.

5. WHICH THIRD PARTIES WILL BE ABLE TO ACCESS YOUR PERSONAL DATA?

In accordance with the details in this Privacy Policy, your personal data may be communicated or accessed by the following third-party recipients:  

  • Energy Distribution Companies, in order to manage access to the network for supplies or services contracted through the Website.
  • AUDAX Group Companies, for internal administrative and management purposes of the Group, based on our legitimate interest and in accordance with applicable regulations.
  • Service providers. Similarly, AUDAX may use other providers to whom it has entrusted the provision of certain services, such as, for example, qualified providers of electronic trust and digital signature services, marketing and commercial information agencies, debt collection agencies, or technology service providers, among others. In any case, these third parties will have limited access to your personal data, which they will access with the necessary safeguards and solely for the performance of the delegated tasks. They are obligated not to disclose the information or use it for purposes other than those strictly related to the services entrusted to them through the appropriate data processing agreements.
  • Credit information systems. In the event of non-payment or breach of monetary obligations, AUDAX may communicate your personal data to credit information systems and to the managing entities of the asset solvency files, in accordance with the provisions of the applicable regulations.
  • Banks and financial institutions, with the aim of managing the collection or payment of the contracted services.
  • Judicial and administrative authorities and State Security Forces and Corps. Finally, AUDAX may disclose your personal data when required by law, at the request of competent police and/or public authorities, due to the existence of a judicial procedure or the investigation of any type of suspicious or criminal activity.
6. INTERNATIONAL DATA TRANSFERS

With regard to certain services, we may need to transfer your personal data to providers located outside the European Economic Area (EEA) (European Union countries plus Liechtenstein, Iceland, and Norway). These transfers may occur if any of the servers hosting certain information are located in one of these non-EEA countries.

In the event that AUDAX needs to transfer data to entities located in these countries, we will ensure beforehand that your information is preserved appropriately, applying the level of protection required in accordance with our local data protection legislation and only transferring personal data in accordance with the standard contractual clauses approved by the European Commission or the appropriate safeguards provided by EU privacy regulations.

7. WHAT SECURITY MEASURES DO WE APPLY?

AUDAX will adopt the necessary technical and organizational measures to guarantee the confidentiality, integrity, and security of Users' personal data, as well as to prevent its loss, alteration, unauthorized processing, or access, taking into account the state of the art, the nature of the data processed, and the risks to which it is exposed. Furthermore, AUDAX periodically checks its systems to detect potential vulnerabilities and attacks.

However, Users are aware that internet security is not impenetrable and that there is no guarantee that personal data cannot be accessed, disclosed, altered or destroyed if a breach occurs that affects any of the security measures implemented.

8. WHAT RIGHTS CAN YOU EXERCISE?

 

As a User and data subject, you have the following rights, which you may exercise at any time, freely and without charge:

Revocation of consentWithdrawing consent that authorizes the processing of your data for a specific purpose will not affect the lawfulness of the processing that was based on it prior to its withdrawal.

If necessary, and when there are reasonable doubts about the identity of the individual making the request, AUDAX may request the User to provide their national identity document number or a copy of their passport, passport, or any other document considered valid for verifying their identity. Likewise, if you are exercising your rights on behalf of another interested party or data subject, and as their authorized representative, you must prove your identity as their representative and provide the document that certifies said authorization.

We will consider all requests and respond to them within the legally established deadlines, although, in any case, you can file a complaint with the Spanish Data Protection Agency (www.aepd.es), when you consider that your rights recognized by current legislation have been violated.

9. OBLIGATION TO PROVIDE YOUR PERSONAL DATA

AUDAX informs you that the personal data collected through the forms included on this Website are, in general and unless otherwise specified in the required field, mandatory for the fulfillment of the purposes described, so that, in the event of refusal or the existence of errors in its provision, it will be impossible for us to adequately offer you the requested products and services.

However, the above will not affect in any way access to the freely viewable content offered through the Website.
